ICIRR statement on Supreme Court birthright citizenship ruling

On June 27, the Supreme Court ruled on CASA v. Trump, a decision that upends settled law, sows legal chaos across the country, and compounds the MAGA assault on Constitutional rights. 


The following is a statement from Lawrence Benito, Executive Director at ICIRR regarding today’s ruling:


“This morning the Supreme Court decided to bend to President Trump’s will and fracture our nation’s legal identity. This ruling fuels the chaos and uncertainty that the Administration was trying to cause with its day one executive order, in blatant disregard of the clear language of the 14th Amendment and decades of Supreme Court precedent. 


“As the Trump Administration continues its attempts to end birthright citizenship, we must be clear: birthright citizenship is a promise enshrined in our US Constitution, and it is a guarantee that must equally apply to all, not decided on a state-by-state basis. In Illinois birthright citizenship remains law, but that will not be true in every state after the executive order takes effect in 30 days. 


“We expect further court challenges to this Administration’s executive order and ultimately a definitive ruling from the Supreme Court that upholds the Constitution and closes the Pandora’s box that they opened today. We stand by our partners at CASA as they pursue a nationwide class action, along with those across the country whose futures are rendered uncertain because of the Supreme Court and the Trump Administration.”
